eBay wins Tiffany fakes case
Auction website eBay has won a four-year legal battle with jeweller Tiffany & Co over claims by the jeweller that eBay was a 'rats nest' of fakes (first reported in 'In the News' on 12 December 2007). A judge in New York found that, while he was sympathetic to Tiffany's problems, it was ultimately Tiffany's (and not eBay's) responsibility to police the number of fake goods being sold.
The ruling follows a similar case earlier this month, this time in France, which eBay lost against the maker of Louis Vuitton, Christian Dior, Givenchy, Kenzo and Guerlain designer goods (reported in 'In the News' on 1 July 2008). The case had led some commentators to predict a flood of cases against eBay by brand-owners - which now looks likely to be stemmed by the Tiffany case.
